The iPhone maker is seeking to hammer home last week's courtroom victory in a patent dispute with a ban on eight of Samsung's phones in America. US District Judge Lucy Koh, who presided at the trial in San Jose, California, will hear arguments from both sides on September 20.
“We will take all necessary measures to ensure the availability of our products in the US," Samsung said.
The pledge by Samsung to fight Apple's action suggests the South Korean company is in no mood to compromise even after a US jury found that its phones violated six Apple patents that covered the design of the iPhone as well as the software inside the phone.
Experts said that given the one-sided nature of Apple's victory, the Californian company has a good chance of securing the ban. "The evidence and weight of the case are heavily in Apple's favor," said Peter Misek, an analyst at Jefferies. "We expect there is a two-thirds chance of an injunction against Samsung products."
Should Apple succeed in securing the ban, the blow for Samsung would initially be softened because the eight phones are no longer bestsellers in the US. However, legal experts warned that Apple could use its courtroom victory to push for a ban in the US on Samsung's current bestsellers, including the Galaxy S III phone.The US accounted for about 12pc of Samsung's handset sales last quarter.Apple, which is expected to launch the latest version of the iPhone in the next fortnight, also wants Samsung to pay it a licensing fee in the wake of the patent ruling.The escalating fight between Apple and Samsung came as FoxConn, the Chinese company that assembles handsets, slumped to its worst first-half loss because of waning demand from the likes of Nokia and Motorola.
